Anxiety L.A. Listing Agreement

This agreement is between Ballpoint Labs, LLC, a California limited liability company ("we," "us"), which operates Anxiety L.A. at anxietyla.com, and the therapist agreeing to it ("you").

1. What this is

This is an advertising listing. We publish a profile page describing your practice, with links to reach you directly.

That is the entire service. We are not a referral service, a group practice, an employer, or a clinical entity. We don't match clients to therapists, screen anyone who contacts you, or participate in any way in the care you provide.

For paid listings, we charge a fixed annual fee. We are never paid per client, per inquiry, per appointment, or as any share of what you earn.

2. What we don't promise

We make no representation about traffic, search ranking, inquiries, or clients. We don't know how many people will see your profile, and we won't estimate it. Nothing on this site or in anything we send you should be read as a projection of what a listing will do for your practice.

3. Ownership disclosure

Anxiety L.A. is operated by Ballpoint Labs, LLC, a California limited liability company. Its owner, Will Baum, LCSW, holds a complimentary listing in the directory. He pays no fee for it. His listing receives no preferential placement, appears in the same randomized order as other listings, and is never featured.

4. Placement

Listings on browse pages appear in randomized order, reshuffled for each visit.

In ZIP search, results are grouped by distance from the searcher's ZIP code and randomized within each distance band. Where your office is affects where you appear. Nothing you can pay for does.

Nobody can buy position in the ordinary listings.

If we later offer featured placement, it will be visibly labeled as advertising, limited in number, and will never replace ordinary listings on the page.

5. Term and fees

Standard listings collect a payment method at signup, with the first charge after the free period. You'll be notified before it happens.

Billing is annual. You can cancel at any time through your listing management page. If you cancel during the free period, you won't be charged. If you cancel after you've been charged, cancellation takes effect at the end of the current paid period, and there's no refund of that period.

6. Price changes

If we raise the price, you keep your current rate for as long as your subscription stays continuously active. A lapse ends that protection.

Any change to pricing or placement rules gets 90 days' notice, and you may cancel for a prorated refund of the unused period.

7. Your license

You represent that you hold a current, active license in good standing with the applicable California board, and that the license number you gave us is accurate.

You agree to tell us within 10 days if your license lapses, is suspended, restricted, placed on probation, revoked, or if you surrender it.

We verify your license number against public records before we publish. After that, we may check status against the boards' published data from time to time, and if a license appears inactive or restricted we may unpublish your listing while we confirm. We'll contact you when that happens. Nothing here obligates us to monitor your license, and you shouldn't rely on us to catch a change — that's what the 10-day notice above is for.

We do not evaluate anyone's clinical work, and nothing on the site should be read as our assessment of quality, competence, or fit.

Professional liability insurance. While your listing is active, you must maintain professional liability (malpractice) insurance covering your clinical practice. You agree to tell us promptly if that coverage lapses or is terminated. We may request confirmation of coverage and may suspend or remove your listing if you don't maintain it.

8. Your content

You give us permission to publish the name, credentials, license number, photo, description, practice details, and any public contact information you submit, and to display them on the site and in search results and previews.

You keep ownership. This permission lasts while your listing is published, and — if your term ends without renewal — continues for the reduced page described in §10, until you ask us to take that page down. When you ask for removal, the permission ends, subject to a reasonable period for cached copies to clear.

You confirm that:

  • Everything you submit is accurate and yours to provide
  • You have the right to use any photo you provide
  • Your description doesn't guarantee outcomes or make claims your license doesn't support
  • Your listing complies with your licensing board's advertising rules

You're responsible for keeping your listing current. You may update eligible listing information using the edit link we provide, or contact us for assistance. Some information can be changed only by us: your name and credentials; your license number, board, and its verification status; your practice address and the neighborhood your listing appears in; your practice name; your listed education and years in practice; the email and phone we use to reach you; and whether the listing is published. Email us and we'll change any of it.

9. What you may claim

The directory limits how many concerns and approaches a listing can claim, so that browsing means something. Some concern selections may require a corresponding approach under the directory's current listing criteria.

Current limits and selection criteria are shown when you submit or edit your profile, and may change as the directory evolves. Any such requirement is a consistency check on the information you provide, not a judgment about your practice.

10. Ending a listing

If you ask us to remove it. Email info@anxietyla.com at any time. We'll unpublish within 5 business days and the page stops resolving. No explanation needed.

If we remove it. We may remove or refuse a listing if:

  • The license isn't current, active, and in good standing
  • You don't maintain the professional liability insurance
  • Information is materially inaccurate
  • You don't practice in Los Angeles County or don't work with anxiety
  • Payment fails and isn't resolved within 14 days
  • Content violates this agreement or applicable advertising rules

If we remove a paid listing for reasons other than your breach, we refund the unused portion.

If your term ends without renewal, something different happens, and you should know it before you sign. The listing stops appearing in browse pages, filters, and ZIP search, and we tell search engines not to index it. But the profile URL keeps resolving. It continues to show your practice details with a note that the listing isn't currently active, the link to your website removed, and a list of other nearby therapists on the page. We keep it that way so you can reactivate in one step.

If you'd rather it come down entirely, email us and we'll take the page down within 5 business days.

11. Your relationship with clients

Anyone who contacts you through your listing — including through your website, phone, or email — is your prospective client, not ours. You're solely responsible for screening, intake, informed consent, clinical decisions, records, billing, and everything else about the care you provide.

We have no access to your clinical records and want none.

12. Independence

You're an independent practitioner. This agreement doesn't create employment, partnership, joint venture, agency, or a group practice. You may list anywhere else you like — nothing here is exclusive.

13. Liability

We provide the site as-is. We don't warrant uninterrupted availability, particular search performance, or any result.

Our total liability is limited to the greater of (a) the fees you paid in the 12 months before the claim or (b) $149.

You'll indemnify us against claims arising from your practice, your clinical care, or content you submitted.

14. Changes to this agreement

Material changes get at least 90 days' notice by email. We may require you to accept the updated agreement before the changes take effect. If acceptance is required and you don't accept by the effective date, we'll unpublish your listing and won't charge you again. If you've already paid for a period extending beyond that date, we'll refund the unused portion.

We may make nonmaterial changes, such as clarifications, corrections, or updates to contact information, without requiring you to accept the agreement again.

15. Law and disputes

This Agreement is governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any legal action or proceeding arising out of or relating to this Agreement must be brought in a state or federal court located in Los Angeles County, California, and each party consents to the jurisdiction and venue of those courts.
